Legge di stabilità 2016: obbligo di registrazione del contratto di locazione a carico del locatore
Il contratto di locazione di immobili deve essere registrato entro 30 giorni dalla data di stipula o, se anteriore dalla data di decorrenza. L’obbligo di registrazione, ai sensi del D.p.R. 131/1986, ricade su una delle parti contrattuali interessate nella locazione.
La legge di stabilità, se approvata in questi termini con gli emendamenti attuali, introduce l’obbligo di provvedere alla registrazione a carico esclusivo del locatore. Si precisa inoltre che il locatore, entro 60 giorni dalla data di registrazione del contratto, deve dare comunicazione al conduttore dell’immobile e all’eventuale amministratore di condominio. Per quanto riguarda le spese di registrazione, queste ultime devono, così come previsto in precedenza, essere ripartite tra locatore e conduttore in parti uguali. Qualora il locatore non dovesse adempiere all’obbligo di registrazione del contratto di locazione, il conduttore ha la possibilità di effettuare un’azione giudiziaria che gli consenta di ricondurre il contratto alle condizioni legali previste.
L’emendamento in questione dà la possibilità al conduttore, qualora ci fossero patti che determinano canoni maggiori rispetto a quanto previsto dal contratto di locazione, entro 6 mesi di intentare un’azione giudiziaria volta a ottenere le somme indebitamente pagate e riportare il contratto di locazione alle condizioni legali.
Infine il DDl di stabilità prevede l’efficacia retroattiva della nuova norma a tutte le ipotesi esistenti fin dall’entrata in vigore della L. 431/98.
