Partita IVA inattiva da più di 3 anni, chiusura d’ufficio dall’Agenzia delle entrate e abrogazione delle sanzioni.
Il Decreto 193/2016 collegato alla legge di Bilancio 2017 dispone, sulla base dei dati in possesso dell’Agenzia delle Entrate, la chiusura d’ufficio delle partite IVA inattive da almeno 3 anni, senza l’applicazione della relativa sanzione (da € 500 a € 2.000) prevista in caso di omessa presentazione della comunicazione di cessazione dell’attività. Il contribuente può evitare la chiusura della Partita IVA rispondendo alla comunicazione dell’Agenzia delle Entrate.
Partita IVA inattiva: abrogazione delle sanzioni.
Una delle novità più significative è l’abolizione delle sanzioni, precedentemente previste per i contribuenti che non avessero presentato la comunicazione della cessazione dell’attività nei 30 giorni successivi. Pertanto, dal 3 dicembre 2016, la sanzione da 500 a 2.000 euro, si applica esclusivamente ai casi di omessa dichiarazione di inizio o variazione attività.
Partita IVA inattiva: nuova procedura.
L’Agenzia delle entrate, sulla base dei dati e degli elementi in suo possesso, in caso di accertata inattività nel triennio precedente, invia al contribuente una comunicazione preventiva di chiusura d’ufficio della partita Iva. Il procedimento di chiusura si perfeziona se il contribuente non si oppone. Ribadiamo che la chiusura d’ufficio non comporta l’irrogazione di sanzioni al contribuente.
Il codice tributo 8120, istituito nel 2014 per il versamento della sanzione per omessa presentazione della dichiarazione di cessazione di attività ai fini IVA, a partire dal 1° febbraio 2017 è soppresso.
